Terms of Service — Cedric’s Garden

By accessing or using Cedric’s Garden (the "Service"), available at cedricsgarden.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Cedric’s Garden is a gardening companion web application featuring an AI character, Cedric, who provides gardening guidance, plant care tracking, automated care schedules, and related features. The Service is operated by an individual sole proprietor.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. The Service is not directed at children, and we do not knowingly collect information from anyone under 13.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

• Free tier: up to 3 plants and access to Cedric chat, free indefinitely, no credit card required.
• Paid tier: $4.99/month or $39/year, unlocking unlimited plants, automated care schedules, email reminders, and the weekly Cedric letter.
• Founding Member pricing: early subscribers who join during the founding period lock in $39/year for the life of their active subscription.
• Subscriptions renew automatically until cancelled. You may cancel anytime through your account settings; cancellation takes effect at the end of the current billing period. No partial refunds for unused time, except where required by law.
• Payments are processed by Stripe. We do not store your full payment card details.

Cedric is an artificial intelligence character. His responses are generated using AI models and are provided for general informational and entertainment purposes only.

• Cedric’s advice is not a substitute for professional horticultural, veterinary, medical, or safety guidance.
• AI-generated content may contain errors, including about plant species, toxicity, edibility, or care requirements. Do not rely on Cedric as the sole source of truth for anything related to the safety of people, pets, or plants — verify independently, especially before consuming any plant material or in any situation involving potential harm to a person, child, or animal.
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated response.

You retain ownership of the plant data, photos, notes, and care logs you submit ("User Content"). By submitting User Content, you grant us a limited license to store, process, and use it solely to operate and improve the Service for you, including feeding it back to Cedric so he can respond with context about your garden. We do not sell your User Content.

You agree not to: use the Service for unlawful purposes; attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; use the Service to harass others; or misuse Cedric to generate harmful, dangerous, or illegal content.

The Service, including the Cedric character, Moonridge Meadows branding, design, and underlying software, is owned by us and protected by intellectual property law. Your subscription grants you a limited right to use the Service — it does not transfer ownership of any part of it to you.

We may suspend or terminate your access to the Service for violation of these Terms. You may stop using the Service and cancel your subscription at any time.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Cedric’s guidance will be accurate.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including damage to plants, pets, or property, or reliance on AI-generated advice. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
